Immigrant advocates call it “state-sponsored kidnapping.” But a judge ruled the removal of a child from a family’s custody was in her best interest. The case raises legal questions about whether family members in the country illegally have the same custody rights to children as legal U.S. residents. Olivia and Francisco Perez’s 15-year-old daughter gave birth to a child in troubling circumstances. The family says she was raped by an acquaintance. The teen allegedly hid the pregnancy from her parents until she gave birth. She was later prosecuted for child endangerment and attempted murder of the child and sentenced to five years in prison. The toddler was placed in DES custody. That was two years ago.
